Inmate Found Dead Weeks After Starting Sentence
Robert Fisher, a 34-year-old man convicted in the case of 3-year-old Josefina “Josie” Cunningham, was found deceased at Elmira Correctional Facility on October 22, 2024.
Fisher had been serving a 20-years-to-life sentence for crimes committed in Rensselaer, New York, in 2023.
The Department of Corrections and Community Supervision (DOCCS) confirmed his passing, although the Chemung County Medical Examiner’s Office has not yet disclosed the cause of death, which remains under investigation.
Fisher died less than two months after being sentenced on September 10, 2024.
Crime Committed Under His Care
Fisher had been trusted to babysit Josefina, but tragically, his actions on July 7, 2023, led to her untimely death.
Reports indicate he administered medication to the child and caused harm, later attempting to conceal his actions.
Judge Called Fisher a Threat to Society
In July 2024, Fisher pleaded guilty to serious charges, and in September, Judge Debra Young called him “a threat to society” during his sentencing.
She expressed hope that any future parole board would deem him unfit for release. Fisher, when allowed to speak in court, chose to remain silent.
Reactions to Fisher’s Death
Fisher’s death brought mixed reactions from the community. For some, it provided a sense of closure. Rensselaer Police Chief Warren Famiglietti acknowledged the relief many felt but refrained from offering his own opinion, stating, “It appears that justice was ultimately served by a power much greater.”
According to News10, Josefina’s brother, Jy’Quan Stewart, vowed to honor his sister’s memory by advocating for “The Josie Act,” a proposed federal law aimed at increasing penalties for severe crimes and giving families of victims more options for seeking justice.

The circumstances surrounding Fisher’s death remain unclear, as authorities continue to investigate.
The official cause of death has not yet been confirmed, and updates will be provided as new information becomes available.

Josefina was remembered fondly by those who knew her. Described as nurturing, playful, and imaginative, she brought joy to those around her.
Her smile was said to light up a room, and she had a loving nature that made her a favorite among family and friends.
