Four men have been charged in a Johor court for the killing of a man believed to be missing and whose body was found tied up in a net and floating in a river. How Han Wei, 33, a used-car dealer, and the two lorry attendants, Lim Yong Ming, 26, and Achuthan Nagarajan, 32, as well as lorry driver Yogesvaran Subramaniam, 40, were summoned before Magistrate Mustaqim Sukarno in Batu Pahat. No plea was recorded during the proceedings, as murder is strictly a High Court matter.

Low Kai Xian, 39, was identified as the victim who was missing for days before his body was found. The court records show the four were charged with killing between a restaurant at Emas Putih in Taman Sri Skudai, Johor Bharu, and the town of Sungai Tanjung Sembrong. The alleged crime occurred between 2:35 PM, July 29, and 12:30 PM, August 3.

A Troubling Discovery in the Water

It all started on July 29, when the family of the victim reached out to the police and said they were unable to contact him on the phone and had been worried about him. Low was found in Johor Baru in his car that he used for so many things, but no traces of him were found shortly after his disappearance. The investigation was successful after days when a member of the public reported a floating object that seemed suspicious in Sungai Tanjung Sembrong to the police at 12:30 PM on August 3.

Emergency agents found the body, and the preliminary investigation by police uncovered some of the gruesome details of the crime. Low’s hands and legs were also taped; physical injuries were found all over his waist and arms. The suspects are accused of committing the offence under the provisions of Section 302 of the Penal Code in conjunction with Section 34, which deals with the case of several persons acting in the furtherance of a common intention. A conviction in Malaysia under Section 302 would be punished by death or prison terms ranging from 30 to 40 years. If the court sentences the man to prison instead of execution, the law requires that he receive at least 12 strokes of the cane.

The state was represented by Deputy Public Prosecutor Firdaus Ruslan, and the four accused showed up without lawyers during the court session. After reading out the formal charge sheet, after the court interpreter, the men just looked at each other to show that they understood the allegations.

Court Awaits Crucial Forensic Evidence

Prosecutor Firdaus requested a new mention date to give the investigating authorities enough time to put together important technical evidence, given the complexity of the investigation. Police are waiting for the outcome of the victim’s post-mortem, DNA tests, surveillance camera reviews and digital forensic reports from mobile phones they seized in the case.

Murder is a non-bailable crime, and Magistrate Mustaqim refused bail to the four accused men. The court granted the prosecution’s request for more time and set a next court mention date for October 14, when it is expected that the full forensic documentation will be provided to the defence and prosecution.
